The State of Texas, through its Department of Family & Protective Services, Child Protective Services Division, has the legal right to take children from parents if certain criteria are met, and to have their parent-child relationship legally terminated if the State proves certain facts exist. Both parents as well as the child legally must have legal counsel during these proceedings. Sometimes, foster parents, grandparents, or other kin may want to intervene in a CPS case to have the children taken by CPS placed in their home on a temporary or permanent basis.
